Osun; APC withddraws petition against Adeleke

The All Progressives Congress, (APC has withdrawn election petition earlier filed against the emergence of Governor Ademola Adeleke at the gubernatorial poll held in August.

The APC lawyer Seyi Oyagbile withdrew the motion on Tuesday at the Tribunal office located inside the Osun State High Court in Osogbo.

The first petition, which is numbered EPT/Os/Gov/01/2026, was filed by the Osun APC governorship candidate, Asiwaju Munirudeen Bola Oyebamiji against Ademola Nurudeen Jackson Adeleke of the Accord Party.

There was another petition numbered EPT/Os/Gov/02/2026 filed by the Peoples Democratic Party, [PDP] while the Independent National Electoral Commission, [INEC] Accord Party and Senator Nurudeen Ademola Adeleke were named as respondents.
The PDP has however distanced itself from the petition.

According to the document obtained by IrohinOdua and stamped by Tribunal Secretary Belemo Diete-Spiff, the counsel officially noted his plan to withdraw the petition filed for Oyebamiji and the APC.

The process, titled “NOTICE OF MOTION TO WITHDRAW PETITION,” stated, “TAKE NOTICE that this Honourable Tribunal/Court will be moved on……….the…………… day of.. 20 0 at the hour of 9 o’clock in the forenoon or as soon thereafter as the petitioner or counsel on his behalf can be heard praying the Tribunal/Court for an order enabling the Petitioner to withdraw the above petition on the following ground(s): DECISION OF PETITIONER.
“Dated this 8TH day of SEPTEMBER 2026.”
Oyagbile acknowledged over the phone that he filed a request to drop the lawsuit, stating, “Yes, I submitted a notice to withdraw it.” Earlier, IrohinOdua noted that lawyers representing the Osun State APC rejected the petition that originally challenged Adeleke’s win in the August 15 election.

A representative of the legal team stated, one Adekunle Adegoke (SAN), said nobody filed a petition for the APC candidate, Oyebamiji, or the party before the tribunal.

Adegoke said his legal team met with Oyebamiji and other party leaders after the election results came out to plan their strategy. He noted that, after further talks, the group chose not to contest the election outcome.
The PDP National Publicity Secretary in a statement made available to Irohinoodua tagged Disclaimer of Unathorise Election Petition No. EPT/OS/GOV/02/2026 and signed by Hon Jungudo Harun Mohammed noted that the legal team of the party is taking steps to withdraw the name of the PDP from the petition.

He said “Any person found to have impersonated the Peoples Democratic Party, [PDP] its officials, National Legal Adviser, consel of any authorised representative of the Party, or to have fraudulently presented any document as having been issued or authorised by the Party should be arrested and prosecuted in accordance with the law.”
